What Does Probate Mean?

Do your clients have questions regarding probate?  Marilyn Hoglen, Senior Vice President and Branch Manager at our Frisco office, has your answer. Click here to watch her video on probate.

If the Decedent had a will, the threshold question is whether or not the will has been "probated".  Until the will is probated, it has no effect at all.  Probate is the legal process of filing the will in the probate court of the county where the Decedent lived when they died.  Once the will is probated and the representative of the estate, the Executor, is duly appointed, then they are issued Letters Testamentary giving them authority to dispose of the property in accordance with the terms and conditions set forth in the will.  The beneficiary or beneficiaries named in the will to receive the real property are the owners of that property.

The staff at Republic Title is experienced in dealing with transactions involving these issues and stand ready to assist you and your client with your questions.
