What Does Probate Mean?

If the Decedent had a will, the threshold question is whether or not the will has been "probated".  Until the will is probated, it has no effect at all.  Probate is the legal process of filing the will in the probate court of the county where the Decedent lived when they died.  Once the will is probated and the representative of the estate, the Executor, is duly appointed, then they are issued Letters Testamentary giving them authority to dispose of the property in accordance with the terms and conditions set forth in the will.  The beneficiary or beneficiaries named in the will to receive the real property are the owners of that property.
